The trial in the "Respirators" case continued today in the Court of Bosnia and Herzegovina, in which Fadil Novalić, Prime Minister of FB&amp;H, Jelka Milićević, Federal Minister of Finance, Fahrudin Solak, suspended director of FCPA and Fikret Hodžić, owner of "Srebrna malina" are accused of a corruption affair worth 10.5 million KM.Today, prosecutors continued to question witness Bahra Džaka, the secretary in the Office of the accused Novalić, who knew about all the offers that reached the Government, including those of "Srebrena malina" by Fikret Hodžić.When asked by prosecutor Mirza Hukeljić, she replied that it was not an envelope that went to the director of KCUS, Sebija Izetbegović, by mistake, "but a piece of paper with the handwritten „Canada“ " on it.

She confirmed that several offers had arrived at the Office of the Government of FB&amp;H, at least three, and that the last offer was from Fikret Hodžić and "Srebrena malina".
However, as she said, this offer of "Srebrena malina" did not seem serious to her, which is why she did not send it to the FB&amp;H Public Health Institute.
-Only at the end of May can we deliver the first quantities. There are 400 pieces in stock, price 90,000 KM + VAT. That is the only thing that is available today. This is best in class. They can be delivered in Sarajevo in seven days – it is written in one of Hodžić's messages to Džaka.
She also confirmed that in later correspondence with Hodžić, he sent an e-mail stating that the government must send a letter of intent to the Chinese, and even sent a letter of intent from the Serbian government about buying respirators, which they sent to China.
Džaka said that the Government wrote the letter and translated it into English, but that by mistake, she wrote 200 respirators, instead of hundred. Džaka later explained that the first letter of intent contained a facsimile of the signature of Prime Minister Novalić, which she had placed because the prime minister was busy.
She added that the first letter of intent signed on 2nd of April was an offer for HC-VE003 respirators, but that a second letter of intent which was brough by Zoran Blagojević, Prime Minister Novalić's external public relations consultant, was signed on 15th of April . There was a hurry and as she said, she pulled Novalić out of the meeting and he just signed while standing.

However, after the respirators arrived in B&amp;H on May 16th last year, Prime Minister Fadil Novalić sent a message to Džaka at 3:30 PM:
-Please check this one more time. I found out about the AM812A from the media. That one did not cross us- Novalić wrote to the secretary, and she had previously written to him "as far as I remember, there are none of those we asked for"
As she said, she concluded that Novalić did not know which respirators were ordered. In the message, Džaka reminded him that the second letter of intent he had signed contained that code.
She explained that the letters of intent are not a binding act, but only an expression of intent to procure respirators.
Answering the question of Novalić's lawyer Vasvija Vidović, Džaka explained that Fikret Hodžić's offer did not have any special treatment in relation to the offers from the other two offers, including offer „Canada“.
Prosecutor Džermin Pašić later reformulated that into a question "did you communicate with others who sent offers in the same way as with Fikret Hodzic", to which Džaka briefly replied "no".
She also confirmed that Hodžić had sent another offer for medical equipment, and that she had previously sent him a table with the required equipment. She could not answer the question where the table came from and who made it, but later, when asked by the defense, she confirmed that the Public Health Institute had sent a list of necessary medical devices.

Hodžić made an offer which he sent on the same day, April 1st, last year, 15:01 with a total value of equipment of 3,393,000 KM.
Explaining the way of working in the office of Prime Minister Novalić, Bahra Džaka explained that Hasan Ganibegović was the director of the Prime Minister's Office and her direct superior, and that every act was reviewed so that he could initial it. The witness said that Ganibegović had certain objections to her work, but that they overcame everything. Judge Branko Perić was just interested in what Ganibegović resented to Džaka.
- The director did not want to initial the first letter of intent - said Džaka, who replied via viber that she must send it because of the hurry, to which he replied "send it" briefly.
The prosecutors were interested in the communication between Bahra Džaka and Vildana from KCUS (then the secretary of the general director Sebija Izetbegović), considering that Džaka confirmed that they did not know each other personally, and that she sent the offers they received for respirators. She confirmed that she had talked to Vildana on two occasions and that it was probably a matter of resolving the "Canada" paper problem.
Džaka also forwarded offers for respirators to her friend, anesthesiologist Aida Čorbeg, in order to inform her "what is available on the Chinese market and whether those that FB&amp;H wants to buy are good". Čorbeg will be questioned in the continuation of the trial scheduled for April 16th.

A total of 4,594 samples were registered with the Public Health Institute of the Federation of B&amp;H in the past 24 hours, of which 1,163 were positive for SARS-CoV-2.

New cases have been registered in all the cantons in the Federation of B&amp;H, stated the FB&amp;H Institute of Public Health.
There are currently 19,313 active cases of SARS-CoV-2.
In the past 24 hours, 46 new deaths were reported to the FB&amp;H Public Health Institute. As of today, the number of deaths in the Federation of B&amp;H is 4,040.
After testing 157 samples, 105 new cases of coronavirus infection were registered in the Brčko District. 14 patients recovered. Three people have died in the last 24 hours.
In the entity of Republic of Srpska, 1,266 samples were tested in the last 24 hours, and coronavirus (SARS-CoV-2) was confirmed in 474 people.
Thirty deaths were reported in the last 24 hours.
So far, a total of 2,863 people have died in the RS.
The total number of hospitalized is 1,461. There are 108 people on the ventilators, stated the RS Public Health Institute.&nbsp;

Chancellor Angela Merkel supports demands for a short, tough lockdown in Germany to curb the spread of the coronavirus as infection rates are too high, a German government spokeswoman said on Wednesday.

Germany is struggling to tackle a third wave of the pandemic and several regional leaders have called for a short, sharp lockdown while the country tries to vaccinate more people.
-Every call for a short, uniform lockdown is right- deputy government spokeswoman Ulrike Demmer told reporters, adding Germany was seeing a growing number of intensive care patients.
-We need a stable incidence below 100- she said, referring to the number of cases over seven days per 100,000 inhabitants. It is currently 110.1, according to the Robert Koch Institute.
She also said that the government was looking at whether nationwide, rather than regional, measures were needed.
-The range of regulations does not help acceptance- said Demmer. While some states have imposed night-time curfews over Easter, others are experimenting with some easing of restrictions.
The majority of Germany’s 16 federal state premiers was against bringing forward talks scheduled for April 12 on what action to take.
The number of confirmed coronavirus cases in Germany rose by 9,677 on Wednesday to more than 2.9 million, the Robert Koch Institute (RKI) for infectious diseases said. It has warned that the numbers may not yet show the full picture as not all cases were registered over Easter. Some 77,401 people have died.

Russia on Wednesday warned Zoom that it could be completely blocked in the country after local media reported that it had restricted access to government agencies and state-owned companies.

The US company has emerged as the global leader in video-conferencing applications, becoming ubiquitous as companies and schools moved online after the outbreak of the coronavirus pandemic. 
Russian media reported Wednesday that Zoom had banned its distributors from selling to government agencies and companies in Russia and a number of post-Soviet countries known as the Commonwealth of Independent States over concerns of new US sanctions against Moscow.
Alexander Bashkin, a member of Russia's upper house of parliament, told the state-run RIA Novosti news agency that Moscow could be forced to respond.
-Russia is not a supporter of sanctions, but if Zoom takes such a decision with respect to government agencies and state-owned companies, then it is possible to block this service in our country as a reciprocal, symmetrical measure- the Federation Council lawmaker was cited as saying.
Russia has previously blocked Western online platforms such as LinkedIn, and in March began slowing down the speeds of Twitter's services in the country in an attempt to force the US social media giant to remove what it says is "illegal content".
President Vladimir Putin has complained that large tech companies are competing with states and authorities are aiming to build up local competitors that can replace Western platforms. 
Education Minister Sergei Kravtsov said that Russia's schools would not be affected by a potential Zoom ban, adding that the country's new video-conferencing system Sferum could serve as a replacement.

Russia's nuclear agency Rosatom said it would likewise have no problem with Zoom being banned.

Former Italian prime minister Silvio Berlusconi has been hospitalised for the second time in two weeks, a source within his Forza Italia party said Wednesday. 

The flamboyant 84-year-old billionaire and media tycoon has been at Milan's San Raffaele hospital since Tuesday afternoon, the source said.
Berlusconi arrived for a check-up, and doctors decided to keep him in to conduct more tests, the source added.
The hospitalisation was also announced by one of Berlusconi's lawyers during a hearing in Milan linked to his long-running "bunga bunga" sex scandal. 
The hearing is part of the latest prong of the investigation into Berlusconi's relationship with an underage girl, Karima El-Mahroug, dubbed "Ruby the heart-stealer".
The probe involves alleged payments to witnesses by Berlusconi to buy their silence over his so-called "bunga bunga" parties involving El-Mahroug and other women.
Berlusconi, who has dominated public life in Italy since the 1980s, has had a string of health problems in recent years.
He already spent a couple of days at the San Raffaele in late March. His entourage said at the time it was to conduct previously scheduled tests. 
In January, Berlusconi -- who had open heart surgery in 2016 -- was admitted to a hospital in Monaco for heart problems. Last September, he was hospitalised for 11 days with Covid-19.&nbsp;

Italy's ex-PM Berlusconi hospitalised again

The University Clinical Center of Republic of Srpska (UCC RS) in Banja Luka today recorded the largest number of patients hospitalized with COVID-19 since the beginning of the pandemic. There are 607 patients and about 80 of them are on ventilators and 400 on oxygen therapy, said General Director of the UCC RS Vlado Đajić in a statement for FENA.

He pointed out that the UCC RS has a total of about 110 ventilators. 
-We have about 110 ventilators, 80 patients are on ventilators, we still have about 30 ready for new patients, but we hope that we will not need them- said Đajić.
He pointed out that a lot of patients who were on ventilators are recovering.
-As far as mortality is concerned, we look at statistics in the world and we are at the top of those who recover and survive. A lot of patients recover who were on ventilators- he said.
Đajić emphasized that they distributed an oxygen network in half of the central medical block in the UCC RS.
-We have oxygen and we can provide it for 500 patients. We consume large amounts of oxygen- said Đajić.
He added that there is still room in this medical institution.
-Unfortunately, we were forced to make triple rooms out of double rooms, so we reduced the comfort a little bit, but the patient still has good accommodation and good service- said Đajić.

Diego Maradona's former lawyer has hit back at the late Argentine football legend's daughters after his offices were raided by anti-fraud police, accusing them of abandoning their father.

Matias Morla and two of Maradona's daughters, Dalma and Gianinna, are embroiled in an inheritance dispute over Maradona's brand and image rights.
-Maradona was abandoned, that's clear. He died alone, apart from the sisters with whom he spoke every day and (his ex-girlfriend) Veronica Ojeda, who went to see him with Dieguito Fernando, his son- Morla told America TV on Monday night.
Morla's offices were raided on Monday as part of an investigation launched after Dalma and Gianinna made a complaint against the lawyer on March 12 for fraudulent administration and fraud.
The two daughters asked for an investigation into the use of the Maradona brand by a company called Sattvica that is owned by Morla.
They accused Morla of "betrayal, dishonesty and abuse" in his management of Maradona's brand and image rights after the star's death.
Sattvica is currently barred from using the brand.
But Morla fired back at his accusers, suggesting the issue was really about money.
-Diego said: 'The Maradona brand will look after my sisters, the image will look after my heirs'," said Morla, adding that the 1986 World Cup winning captain submitted a signed document to that effect with a Dubai court in 2015 or 2016.
Dalma and Gianinna "don't like me because in 2014 we took away their credit cards," added Morla, who has locked horns with the two daughters for years.
Maradona died of a heart attack on November 25 aged 60 while recovering from an operation to remove a blood clot from his head.
In a separate investigation, authorities are looking into the health treatment he received to determine whether there was any neglect or malpractice.
Maradona had battled cocaine and alcohol addictions during his life.
He was suffering from liver, kidney and cardiovascular disorders when he died.
Maradona is an idol to millions of Argentines after he inspired the South American country to only their second World Cup triumph in 1986.
An attacking midfielder who spent two years with Spanish giants Barcelona, he is also loved in Naples where he helped Napoli win the only two Serie A titles in their history.

Amid signs of improving ties between Turkey and the European Union, Turkey’s president on Tuesday received top EU officials paying an official visit to the country.

Recep Tayyip Erdogan met with Charles Michel, head of the EU Council, and Ursula von der Leyen, head of the EU Commission, at the presidential complex in the capital Ankara.
Following the nearly three-hour meeting, at a press conference at the EU Delegation to Turkey, Michel said: “The EU is ready to present a concrete agenda to strengthen cooperation on the economy and immigration, and inter-societal ties.”
He said the EU recognizes the strategic importance of mutually beneficial and positive relations with Turkey and security and stability in the Eastern Mediterranean.
Leyen said the visit is meant to give an impetus to Turkish-EU relations, adding that areas of mutually beneficial cooperation were covered during their meeting with Erdogan.
-We will deal with current hardships in implementation of the Customs Union and eventually work to update it- she added, referring to a 1995 trade deal between Turkey and the bloc.

The Czech government has approved its first loosening of coronavirus curbs this year, including re-opening shops selling children’s clothing and stationery, Industry Minister Karel Havlicek said on Tuesday.

Limited outdoor operations at zoos and botanical gardens will also be allowed, he told CTK news agency.
The relaxation will coincide with a return of 1st to 5th graders to school, which the government is likely to approve later on Tuesday, and the end of curfews and limits on movement around the country when a state of emergency expires April 11.
The Czech Republic has been one of the hardest-hit countries by COVID-19.
Shops, restaurants, services and most school classrooms have been closed almost continuously since October. In March, the government shut all schools and used state of emergency powers to restrict people to their home districts.
Prime Minister Andrej Babis’s minority government has come under criticism from opposition parties for its handling of the pandemic. It will let a state of emergency expire over the weekend after struggling to win approval to prolong its use in recent votes.
The government is also seeking to re-open schools, which have faced the longest period of full or partial closures in the European Union, according to UNESCO data.
The loosening comes as the number of daily infections has dropped below a seven-day average of 5,000 for the first time since mid-December. Hospitalisations have also eased.
However, the death toll has more than doubled to over 27,000 since the beginning of 2021 and is the highest in the world on a per-capita basis, according to Our World in Data.

About 1.6 million views on YouTube out of every 1 billion are of a video that violates its content policies, about even with a year ago, the streaming service owned by Alphabet Inc’s Google said in a new disclosure on Tuesday.The “violative view rate” (VVR) has dropped over 70% since it was first tracked in the fourth quarter of 2017, YouTube said, and demonstrates its progress in blocking hate speech and other videos it considers dangerous before they go viral.
Critics have said inadequate policing by YouTube and other social media companies enables false and hateful rhetoric to spread, fomenting deadly violence such as the U.S. Capitol attack in January.
YouTube’s VVR was steady over the last six quarters measured, according to the new data, which run through 2020.
Jennifer O’Connor, a product director at YouTube, told reporters that she hoped releasing the estimate each quarter “continues to hold us accountable.”
She said the rate, like other enforcement data YouTube releases, could fluctuate as its technology, rules and users evolve. For instance, YouTube removed nearly 171,000 channels for hate speech in the fourth quarter, three times more than the preceding period. It attributed the jump to improved detection technology.
The VVR comprises all policy violations and is derived from a sampling of videos. It does not include comments on videos.
Facebook Inc releases a similar estimate but excludes bullying, spam and other violations. Added up, Facebook has said at least 15 million views out of 1 billion in the fourth quarter were of content violating its rules against adult nudity and sexual activity, violent or graphic material and hate speech.
Countering criticism about “grading” itself, Facebook last year said it would hire an outside auditor to assess its disclosures.
YouTube’s O’Connor on Monday declined to commit to an external audit but said she “wouldn’t rule it out.”

YouTube discloses prevalence of rule-breaking videos for first time

Inspectors of the Federal Administration for Inspection Affairs also entered the premises of the Clinical Center of the University of Sarajevo this morning. They entered on the order of the SC Prosecutor's Office, whose prosecutors, together with state and SIPA members, also searched the institution yesterday.
- On April 6th, 2021., the Federal Administration for Inspection Affairs received a request from the Cantonal Prosecutor's Office of Sarajevo Canton for inspection supervision and submission of information related to the use of mechanical ventilation devices ACM 812A, hygienic conditions, organization of medical staff and conditions and medical treatment of patients that were diagnosed with COVID-19 at KCUS. Pursuant to the request, the Federal Health Inspectorate started the inspection this morning, and it is expected that within three days we will submit the report on the procedure and the collected information / documentation to the competent Prosecutor's Office for further action - the Federal Administration for Inspection Affairs told „Avaz“. 
The search followed after the Cantonal Prosecutor's Office formed a case on the events in this medical institution, which was officially confirmed today by this judicial institution.
Activities at KCUS were launched after a letter from doctors that appeared in public, which spoke about the catastrophic situation at KCUS and stated that "Srebrna malina" respirators could not be used to treat COVID patients.
The prosecution team also included investigators from the Sc Prosecutor's Office and inspectors from the State Investigation and Protection Agency (SIPA), and the entire procedure was led by State Prosecutor Džermin Pašić.

The Office of the Disciplinary Prosecutor of the High Judicial and Prosecutorial Council of B&amp;H (HJPC), which yesterday filed disciplinary lawsuits against the Chief Prosecutor of the Prosecutor's Office of B&amp;H Gordana Tadić and the President of the Court of B&amp;H Ranko Debevec, did not request their suspension.

<h2>Conducted an investigation for more than a year</h2>

The Office of the Disciplinary Prosecutor of B&amp;H did not answer for "Avaz" why the suspension was not requested for the heads of judicial functions, primarily Debevec, who was investigated for more than a year and who, among other things, was accused of inappropriate contact with the person against whom proceedings are being conducted before the court he governs.
This is Osman Mehmedagić, the director of ISA, as evidenced by the published photos in the media.

Debevec is also accused for not declaring property in Spain, but also of intentionally giving false, misleading or insufficient information regarding job applications, promotion issues or any other issues that fall within the competence of the Council. 
From this disciplinary point, it remained unclear whether Debevec was also accused of concealing dual citizenship and dual identity, which he used and traveled properly under the name Ranko Debevec Kaveson.
He was reported to the Office of the Disciplinary Prosecutor that he hid this information when applying for the position of prosecutor, and later judge, as well as for the competition for the head of the Court of B&amp;H.
After all, Debevec used the dual citizenship of Spain, and it is disputable that B&amp;H has not signed an agreement on dual citizenship with the Kingdom of Spain. This means that Debevec could not even have dual citizenship of B&amp;H and Spain.

However, the Law on the HJPC B&amp;H is clear. It is now up to Halil Lagumdžija, the president of the HJPC, who will form the First Instance Disciplinary Commission, which will decide on disciplinary lawsuits against the leaders of Bosnia and Herzegovina justice.
In addition, the decision on temporary removal from the office of judicial office is made by the First Instance Disciplinary Commission at the request of the Office of the Disciplinary Counsel, which may be submitted subsequently.
However, given the disciplinary points of the lawsuit against Debevec, including "making inappropriate comments through communication with the prosecutor in the case in which the defendant is a participant in the proceedings", it is obvious that the request for suspension against the head of the Court of B&amp;H had to be filed.

The report states that Debevec put pressure on the prosecutor by sending her text messages in an attempt to stop or redirect the course of the prosecutor's checks of the allegations from the criminal report against him.
Article 77 of the Law on the HJPC BiH clearly states.
A judge or prosecutor may be temporarily removed from office "if disciplinary proceedings have been instituted for a disciplinary offense and the Chamber finds that disciplinary liability cannot be properly established without the judge or prosecutor being temporarily removed from office during the proceedings."
However, the temporary suspension is valid only for the duration of the disciplinary proceedings. In the case of initiating a criminal investigation by the Prosecutor's Office, which is also very certain, the Chief Disciplinary Prosecutor is obliged to propose his suspension, until the investigation is completed.

<h2> Ignoring the obligation and order of the Council</h2>

As for Tadić, she is also charged with three counts. One of them is that, as the head of the Prosecutor's Office of B&amp;H, by failing to apply the provisions of the Law on Protection of Classified Information, she failed to initiate the procedure of personal security checks of the staff of the Prosecutor's Office of B&amp;H handling classified information.
It was also stated that the Council's obligation and order to allocate prosecution cases to prosecutors through the automatic distribution system (TCMS) during her term as Chief Prosecutor was also neglected.

The FB&amp;H Securities Commission, which is a crucial institution ensuring that banks, the stock exchange and joint stock companies operate transparently and according to the rules, has been completely paralyzed for more than a year. The consequences of this paralysis are enormous for the economy of the Federation of Bosnia and Herzegovina and the country as a whole. The Commission sets the conditions for how money flows through banks and businesses and for that reason affects hundreds of companies, their employees and business partners, as well as citizens.

Over 400 pending requests are awaiting the Commission’s approval including more than BAM 100 million worth of investments. This is happening while the country is suffering from the health and economic crisis brought on by the pandemic. Economic recovery and employment growth are threatened by the inability of companies and banks to raise capital, merge with other companies, or conduct other normal business transactions. Securities Commission employees have also been suffering because no one was able to authorize the payment of their salaries or health insurance.
The effective financing of companies is the starting point for economic growth and welfare. As has been noted many times, a key factor in supporting economic growth to create new jobs is to make money available to entrepreneurs for investment. A well-functioning Securities Commission is a prerequisite for this to happen.
We urge the Federation authorities to unblock the work of the Securities Commission by immediately addressing the appointment of its members and taking all necessary steps to ensure that appointment decisions can be made swiftly while fully respecting all relevant legislation and selection criteria.

<h2> Independence and professionalism</h2>

Independence and professional conduct are crucial for ensuring high standards of excellence of all supervisory authorities. The institutions need to operate in a clear and transparent manner in order to build trust in the market.

Both EU standards and domestic regulation define strict criteria for the selection of Securities Commission’s members, including with regard to education, expert and professional knowledge, conflict of interest, performance of duties in political parties, participation in political activities and criminal record.
There are many successful, hardworking citizens of BiH who meet these criteria and deserve the opportunity to make a difference and offer their expertise and experience for the benefit of their country.
Market participants and businesses demand an urgent remedy to the situation from all bodies involved in the process, including the immediate restoration of the functionality of this institution and avoiding any future dysfunctionalities. The Federation of Bosnia and Herzegovina, as one of the entities within a democratic country aiming to join the European Union, cannot afford the paralysis of one of its important institutions.
